Since its introduction in Nowra in 2002,1 Circle Sentencing has proven to be for the most part, beneficial to the aboriginal community and subsequently the general community in New South Wales. Current NSW legislation2 provides a legal framework for a more personal model of sentencing and punishment for aboriginal offenders. An analysis of the purpose, structure and effects of Circle Sentencing allows for a greater understanding of its advantages and disadvantages and furthermore shows the overall importance of this mechanism for members of the Aboriginal community. In other Australian states and territories, courts and legislation have adopted slightly different approaches to the idea of sentencing aboriginal offendors.
