Is there any difference between negligent acts/conduct and negligent statements that cause pure economic loss An act can cause pure economic loss without anyone hearing about it. A duty of care is possible but there have been very few successful cases. Prior to the case of Caltex Oil (Aust.) Pty. Ltd. v. The Dredge Willemstad (1976) 11 ALR 227 you couldn't bring an action for pure economic loss caused by conduct. The duty criteria remain unsettled. There are no clear principles that can be applied by reference to a particular case. One can only look at the approaches taken by individual judges in their judgments.
