Principles of Equity Week 1 Overview: Overview of Nature, History and Maxims of EQ History Medieval Times (13th -14th C) Edward I Back then there were three main courts, Kings Bench; Court of Common Pleas; Excehquer. During 14th C CL became rigid and could not keep up with the change times. People became dissatisfied with the sys and lack of justice; these petitions were addressed by the King in Council. Process developed further, where King delegated duty of hearing the petitions to the Lord Chancellor. LC's were bishops & archbishops with no legal background therefore decisions were based on their subjective conscience and influenced by canon law. Process then further evolved and certain measures were created to fix the defects (eg specific perf). The Court of Chancery was created to admin EQ.
